What Level of Arizona Drunk Driving Offense Have You Been Charged With?
Arizona has four basic categories of DUI/DWI charges:
- The basic DUI offense (misdemeanor) —impaired by alcohol "to the slightest degree"
- DUI (misdemeanor) — .08 blood alcohol content measured within two hours of driving
- Extreme/Super Extreme DUI (misdemeanor) — .15 blood-alcohol content measured within two hours of driving (extreme DUI also has a sentence enhancement known as the "super extreme DUI" for drivers who have a .20 blood-alcohol content measured within two hours of driving)
- Aggravated DUI (felony) — drunk driving on a suspended, revoked or cancelled license; drunk driving with a minor under 16 years of age in the car; drunk driving with at least two previous DUI convictions in the last seven years
The Next Steps in Your DUI Defense
As your attorneys, one of the first things we'll do is request an MVD hearing. This will prevent immediate suspension of your license and give you time to make other arrangements, just in case. This hearing can also provide information that will help us prepare for trial — again, just in case.
Following that, we'll work to obtain copies of the police reports and the maintenance and calibration records of the breath testing equipment used by the officers. We'll also seek to obtain one of the blood samples that were taken from you and have that sample retested by an independent laboratory. If we find problems in these areas, rest assured we will make problems for the prosecutors trying to convict you.
Failing that, an effective DUI defense can still be mounted on the basis of other issues including probable cause, evidence handling and police procedures. Whatever the situation turns out to be, we will stay focused on achieving the best possible result at every stage of the case.
